Description

The 2005 amendments to the Bankruptcy Code gives goods sellers a Section 503(b)(9)  priority claim  for unpaid goods delivered within 20 days of a debtor's bankruptcy filing. This new priority claim has increased the likelihood of payment of these claims. However, questions have arisen on how to assert these claims in the absence of a uniform statutory rule and deadlines that vary by jurisdiction.
